Terms of Service & Operational Covenants

1. Operational Scope & Advisory Boundary (Level A0)

The Jantar platform is provided by SKOPAQ AI PRIVATE LIMITED at Authority Level A0 (Advisory Only). Jantar provides automated root-cause analysis, knowledge graph traversal, cited insurance evidence, and drafted recovery procedures. Jantar does not possess autonomous commanding capability. The customer's certified flight controllers and spacecraft operations personnel retain sole, non-delegable authority and responsibility for evaluating, approving, and transmitting telecommands to any orbital asset.

2. Prohibition on Automated Command Uplink (ADR 0018)

Customers and operators agree never to pipe, automate, or route outputs, procedures, or recommendations generated by Jantar directly to any ground station transmitter, RF baseband equipment, or telecommand uplink stream without certified human operator verification. Violation of this covenant immediately terminates the software license and indemnifies SKOPAQ against any resulting orbital claims.

3. Mandatory Statutory EUC Requirement (IN-SPACe Sec B.13)

Pursuant to Section B.13 and Section C.III.c.i of the IN-SPACe SSA Guidelines (IN:ISP2023:NGP-SSA:2026/V1.0), receipt of any telemetry analytics or SSA services requires the customer to execute the statutory Annexure-3 End-Use cum End-User Certificate (EUC) certifying that the services are used strictly for safe and sustainable satellite operations. Both parties agree to maintain signed EUC records for a minimum of three (3) years for statutory audit inspection.

4. National Security RSO Blackout Compliance (IN-SPACe Sec B.7)

Customers expressly agree that Jantar shall never be tasked to identify, track, attribute, or disseminate data regarding Resident Space Objects (RSOs) designated as restricted by the Government of India for national security. Any attempt to query or disseminate restricted RSOs is subject to Jantar’s designated-object filter: once a designation is registered, references to the designated object are redacted from investigation reports, API responses and outbound notifications.

5. Limitation of Liability & Space Treaties

To the maximum extent permitted by applicable law, SKOPAQ AI PRIVATE LIMITED shall not be liable for any direct, indirect, incidental, or consequential damages resulting from spacecraft anomalies, loss of mission, orbital collisions, satellite de-orbiting, propellant loss, or claims under the 1972 Convention on International Liability for Damage Caused by Space Objects. The customer assumes full operational risk for all actions taken based upon advisory recommendations.

6. Export Control & SCOMET Compliance

Jantar constitutes software designed for aerospace systems and is subject to Indian export control laws (SCOMET Category 7) and foreign trade regulations. The customer warrants that it will not re-export, transfer, or disclose the software, its technical documentation, or derived data to any prohibited entities, sanctioned nations, or unauthorized third parties without prior statutory authorization from the Directorate General of Foreign Trade (DGFT) and IN-SPACe.

7. Intellectual Property & Reference Spacecraft

Jantar's knowledge-graph schemas, reasoning workflows, evaluation harnesses and application code are the proprietary intellectual property of SKOPAQ AI PRIVATE LIMITED. Jantar builds on third-party open-source components, each of which remains the property of its own authors and is used under its own licence. Spacecraft models named JANTAR-REF-1 and related seeded scenarios are synthetic references; no proprietary or classified operator data is distributed within public releases.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India.
